La Veta off the hook; Blanken and Culbreath still on

LA VETA- Last month, Huerfano District Court Judge Leslie Gerbracht had, per stipulation, dismissed the action against the Town of La Veta brought by James and Marion Keffeler, Kelly Popejoy and James McAnally, who claimed the Town Clerk, Nancy Culbreath, “abused her discretion” and “made erroneous legal conclusions, used incorrect legal standards, and erroneously applied the law,” when she made determinations about signatures on a recall petition against Trustee Dawn Blanken that had been circulated around town in October, 2010.
The District Court announced on Monday that it does not agree with the argument
by the Defendants (Blanken and Culbreath) that the Plaintiffs (Keffeler and Company) had failed to exhaust their administrative remedy, and denied the motion to dismiss by Blanken and Culbreath.
This means the case against against the two women will continue to wind through the legal system for several more months. According to Blanken, “The plaintiffs now file, I respond to their filing, they respond to my response.”
