WALSENBURG — During a brief hearing Monday, Feb. 11, the district attorney’s office filed one count of second degree murder (a class 2 felony) against Roberto Lopez stemming from a fatal stabbing at a mobile home in La Veta in early January.
Lopez is charged in connection with the death of Eraclio Lopez-Lopez on Jan. 6, 2013 at a residence the two men shared with others in the 600 block of E. Ryus Ave.
Lopez has remained in Huerfano County Jail since his arrest Jan. 7 at a Walsenburg restaurant.
In other court news: District Judge Claude Appel has a defense motion in the Amanda Daniels case for dismissal due to outrageous governmental misconduct under advisement following hearings late last month.
In that case, a status conference is set for March 25, 2013 and a jury trial has been set to begin April 8, 2013. Both the defense and prosecution have until the close of business on March 11 to submit proposed orders to the court concerning the pending motion to dismiss.
