WALSENBURG— Dylan and Ryan Dougherty made a court appearance on Monday, Nov. 28, seeking a 60 day delay in the proceedings. The delay was agreed to by Huerfano and Las Animas Counties District Attorney Frank Ruybalid.
Ruybalid told 3rd District Court Judge Claude Appel the delay was needed for DNA testing to be conducted by the Colorado Bureau of Investigation.
“The results from the DNA testing and further conversations with other jurisdictions including federal prosecutors along with prosecutors in Florida are necessary.”
Attorneys for both Dylan and Ryan Dougherty sought the delay in order for further discovery, allowing for the testing being conducted by the CBI to be handed over to defense.
The Dougherty brothers will next appear in court on January 30, 2012, where a disposition will be made, or a trial date set.
